Several times last year, PASS submitted 1187 membership applications for employees working in Certificate Management Offices (CMO) within the Office of Flight Standards. These employees were Management and Program Analysts. However, the applications were denied because the employees were designated ineligible for union representation in the FAA’s database. This is also known as being listed as 8888.
Numerous discussions were held with the FAA but with no resolution. As a result, PASS filed an Unfair Labor Practice charge for the agency’s failure to process the 1187s as well as a petition to clarify whether the positions should be in the Flight Standards bargaining unit. On May 18, 2018, PASS signed a settlement agreement with the agency placing the employees in the bargaining unit. However, a review of agency data shows that there are 40 or more MPAs in CMOs and Flight Standards District Offices who are still listed as ineligible for union representation.
